Commonwealth v Lavoie, Cierre Courtroom

Hoy en día el SJC publicado Commonwealth v Lavoie, que aborda la cuestión del derecho a un juicio público y si el abogado puede renunciar a ese derecho en nombre del acusado sin su consentimiento expreso. El Tribunal sostuvo que un abogado puede renunciar a ese derecho, y que lo hizo en este caso. Si la renuncia se encuentra, según el Tribunal, el acusado tendrá que demostrar que el abogado no fue efectivo, al hacerlo, y que fue perjudicado por la decisión de su abogado.

Obviamente, el SJC quiere limitar el alcance de estos desafíos juicio oral y público, ya que la decisión inicial de Cohen que encontró el error de ser estructural (per se) abrió las compuertas. Desde entonces, se ha establecido que la mayoría de los tribunales superiores se cerraron durante la selección del jurado, como cuestión de rutina. Así que no hay manera de que el SJC quiere reabrir todos estos casos. Esto es particularmente cierto en los casos de asesinato cuando el tribunal trae a los miembros del jurado de más, lo que aumenta la probabilidad de que los espectadores le pedirá que deje durante la selección del jurado.

Así, en Lavoie, el Tribunal de Justicia declaró que el abogado puede renunciar a ese derecho en nombre de su cliente, incluso si el cliente no da su consentimiento expreso. Aunque en teoría Lavoie podría haber tratado de establecer renuncia que el abogado era ineficaz asistencia, no hay ninguna manera práctica de demostrar el “perjuicio” patas de la norma Saferian. En esencia, si se renuncia a un abogado, usted está fuera de suerte.

Este caso deja abierta la cuestión de qué hacer en caso de que el abogado no renuncia a la razón, sino que es simplemente ignorante de ello o cuando la renuncia no es una decisión estratégica razonable (como Lavoie al parecer era, que es otra discusión en total).
